Max Miller Ex-Wife Files Suit Over Child Image

Rep. Max Miller is facing a new legal fight after his ex-wife, Emily Moreno, filed a federal lawsuit in Ohio accusing the congressman and his attorney of publicly disclosing a nude image of their two-year-old daughter. The Max Miller child image case centers on a Dropbox folder Miller shared in a public post, which Moreno says included a photograph of the child.

The complaint says Miller and lawyer Aaron Minc violated federal laws covering the disclosure of intimate images. Moreno’s filing claims the folder contained a photograph “depicting her genitalia” and says the image was made available as part of a larger collection of documents. The lawsuit seeks $150,000 in liquidated damages for each time the image was downloaded from what it calls Miller’s and Minc’s public Dropbox, along with attorney fees and litigation costs.

Moreno’s attorney, Subodh Chandra, said in a statement that the child is “an entirely innocent victim” caught up in her father’s political battle. He accused Miller and Minc of reckless conduct by putting the photo online and said the lawsuit is intended to hold them accountable under federal and state law. In his statement, Chandra also argued that any parent or lawyer would understand the risks of posting nude images of a toddler on the public web.

Minc has said the image was included by mistake. In an interview with Politico last week, he acknowledged that he had inadvertently included a photo of the child with her shirt off, but he said there were no images of genitals. In a separate statement, Minc said he alone was responsible for assembling and editing the material in the folder and described the inclusion of the image as unintentional.
